By booking, accepting, or using a motorcycle rented from KJM Motorcycle Rental, the renter acknowledges that they have read, understood, and agreed to the following Terms and Conditions. These terms apply to all daily, weekly, monthly, and long-term rentals unless otherwise specified in a separate written rental agreement.

Terms version: 2026-10-12

1. DRIVER’S LICENSE AND REQUIRED DOCUMENTS

1.1. The renter must present a valid driver’s license legally authorizing them to operate the rented motorcycle in the Philippines.

1.2. Student permits are strictly prohibited.

1.3. Foreign renters must present a valid license and any International Driving Permit (IDP), translation, or other documentation required under applicable Philippine regulations.

1.4. The renter must provide valid identification and any other documents reasonably required by KJM Motorcycle Rental for identity and eligibility verification.

1.5. KJM Motorcycle Rental reserves the right to refuse or cancel a rental if the renter fails to meet the applicable documentation or licensing requirements.

2. AUTHORIZED DRIVER ONLY

2.1. Only the driver identified and approved in the rental agreement is authorized to operate the motorcycle.

2.2. Lending, subleasing, transferring, or allowing another person to operate the motorcycle without prior written approval from KJM Motorcycle Rental is strictly prohibited.

2.3. The renter remains responsible for ensuring that the motorcycle is operated only by an authorized and legally qualified driver.

3. BOOKING, PAYMENT, AND RENTAL CONFIRMATION

3.1. All rental rates, rental periods, payment requirements, and applicable fees must be confirmed before the motorcycle is released.

3.2. A booking is confirmed only after acknowledgment by KJM Motorcycle Rental and completion of any required reservation payment.

3.3. The motorcycle will not be released until the required documents, security deposit, and applicable rental payments have been completed, unless otherwise agreed in writing.

3.4. The renter is responsible for settling all agreed rental fees and additional charges incurred during the rental period.

3.5. Any special arrangements, discounts, or exceptions must be approved by KJM Motorcycle Rental in writing.

4. SECURITY DEPOSIT

4.1. A refundable security deposit of ₱2,500, or another amount specified in the booking confirmation, is required before the motorcycle is released, unless otherwise agreed in writing.

4.2. The security deposit may be applied to outstanding rental fees, late-return charges, traffic fines, missing accessories, documented damage, or other amounts properly payable by the renter under this agreement.

4.3. The motorcycle will be inspected upon return. Any deductions from the security deposit must be supported by a reasonable basis and communicated to the renter.

4.4. The remaining refundable balance will be returned after the inspection and assessment of outstanding charges, within the applicable agreed refund period.

4.5. If the renter’s outstanding obligations exceed the security deposit, the renter remains responsible for paying the remaining balance to the extent permitted by applicable law.

4.6. The security deposit does not automatically authorize an extension of the rental period or continued possession of the motorcycle.

5. FUEL RESPONSIBILITY

5.1. The renter is responsible for all fuel consumed during the rental period.

5.2. The motorcycle must be returned with the same fuel level as recorded at the time of release.

5.3. If the motorcycle is returned with a lower fuel level, the renter may be charged for the fuel required to restore the original level and any reasonable, disclosed refueling service fee, if applicable.

6. LATE RETURN CHARGES

6.1. A grace period of fifteen (15) minutes is allowed after the agreed return time.

6.2. Returns exceeding the grace period may be subject to the applicable hourly extension or late-return fee communicated by KJM Motorcycle Rental.

6.3. An additional charge equivalent to ten percent (10%) of the daily rental rate may apply for excess time, where expressly disclosed and applicable under the confirmed rental terms.

6.4. The applicable charges and calculation method must be clarified to the renter before the rental begins. The same period of delay will not be charged twice under overlapping fee provisions.

6.5. Late-return charges do not automatically authorize the renter to retain or continue using the motorcycle beyond the agreed rental period.

7. RENTAL EXTENSION

7.1. A short-term rental extension of up to two (2) hours may be permitted, subject to prior approval and motorcycle availability.

7.2. All extension requests must be submitted at least two (2) hours before the agreed return time.

7.3. If the motorcycle is retained for more than two (2) hours beyond the agreed return time without an approved alternative arrangement, a full-day rental charge may apply in accordance with the disclosed rental policy.

7.4. Failure to request an extension within the required notice period may result in additional charges under the applicable late-return policy.

7.5. All extensions are subject to approval by KJM Motorcycle Rental. Approval is not automatic and depends on the motorcycle’s availability and subsequent bookings.

7.6. For monthly or other long-term rentals, any extension must be approved in advance. An extension of less than one (1) month will be charged at a rate determined by KJM Motorcycle Rental based on the extension period and current rental pricing. The original monthly or long-term rate will not automatically apply.

7.7. Before an extension begins, the additional rental period, charges, and payment terms must be confirmed in writing.

7.8. Unauthorized extensions are prohibited and may result in additional charges and termination of the rental agreement.

8. NO HALF-DAY RENTALS

8.1. KJM Motorcycle Rental does not offer half-day rental arrangements unless expressly advertised or approved in writing.

8.2. Rental fees are based on the agreed rental duration and applicable rate schedule.

8.3. Any early return or unused portion of the rental period does not automatically entitle the renter to a reduced charge or refund.

9. CANCELLATION, RESCHEDULING, AND NO-SHOW

9.1. Cancellation and rescheduling requests must be communicated to KJM Motorcycle Rental as early as possible.

9.2. Applicable cancellation fees, reservation-payment refunds, and rescheduling conditions will follow the policy disclosed to the renter when the booking is made.

9.3. Failure to arrive at the agreed pickup time without prior notice may be treated as a no-show and may result in cancellation of the reservation and the application of disclosed cancellation charges.

9.4. Changes to the rental date, pickup time, return time, or motorcycle unit are subject to availability and approval.

9.5. KJM Motorcycle Rental may cancel or refuse to release a motorcycle if the renter fails to meet the licensing, documentation, payment, or safety requirements of this agreement. Any refund due will be handled in accordance with the applicable booking terms and law.

10. NO REFUND FOR EARLY RETURN

10.1. Returning the motorcycle before the agreed return date or time does not automatically entitle the renter to a refund for unused rental days or hours.

10.2. Any exception must be expressly approved in writing by KJM Motorcycle Rental, subject to the applicable agreement and law.

11. UNLIMITED KILOMETERS AND GEOGRAPHICAL RESTRICTIONS

11.1. Unlimited kilometers are allowed within the approved rental area, subject to the terms of the booking.

11.2. The renter must obtain prior written approval before taking the motorcycle outside Cebu Province.

11.3. Additional restrictions may apply depending on the motorcycle unit, rental agreement, insurance coverage, destination, or transportation requirements.

11.4. The renter must not take the motorcycle outside the approved area without authorization.

12. TRAVEL OUTSIDE CEBU AND FERRY OR RORO TRANSPORTATION

12.1. Taking the motorcycle outside Cebu Province or transporting it on any ferry or Roll-on/Roll-off (RoRo) vessel requires prior written approval from KJM Motorcycle Rental.

12.2. The renter must provide the proposed destination, travel dates, and relevant transportation details when requesting approval.

12.3. Approval is subject to the motorcycle’s suitability, applicable insurance coverage, ferry operator requirements, and any required permits or documents.

12.4. Any additional transportation, delivery, pickup, or recovery charges must be agreed upon before the trip.

12.5. The renter must not assume that the motorcycle’s insurance coverage remains valid for travel outside the approved area or during ferry transportation.

12.6. Unauthorized travel or transportation may constitute a breach of this agreement and may result in termination of the rental, subject to applicable law.

13. VEHICLE INSPECTION AND DOCUMENTATION

13.1. The renter is strongly advised to inspect the motorcycle thoroughly before accepting it.

13.2. Existing scratches, dents, tire condition, lights, brakes, mirrors, fuel level, mileage, and other visible conditions should be checked before departure.

13.3. Taking photographs or videos of the motorcycle at pickup and return is strongly encouraged.

13.4. Any existing damage or missing accessories should be reported and documented before the motorcycle is released.

13.5. The renter should immediately report any safety concern identified during the inspection before operating the motorcycle.

14. CONDITION UPON RETURN

14.1. The motorcycle must be returned in substantially the same condition as received, allowing for normal wear and tear arising from proper use.

14.2. The renter must return all supplied keys, helmets, raincoats, phone holders, top boxes, documents, and other accessories.

14.3. Missing items or damage beyond normal wear and tear may result in reasonable, documented repair or replacement charges where the renter is responsible.

14.4. The renter must return the motorcycle at the agreed date, time, and location.

14.5. Changes to the return location require prior approval. Additional delivery, pickup, or recovery fees may apply where agreed.

15. ACCIDENTS, DAMAGE, AND INCIDENT REPORTING

15.1. The renter must immediately notify KJM Motorcycle Rental of any accident, collision, damage, or other incident involving the motorcycle.

15.2. When necessary, the renter must contact emergency services, the police, or other appropriate authorities.

15.3. The renter must provide accurate information about the incident and reasonably cooperate with investigations, documentation, and applicable insurance procedures.

15.4. The renter must not abandon the motorcycle or authorize non-emergency repairs without prior approval from KJM Motorcycle Rental.

15.5. The renter may be held responsible for documented repair costs, replacement costs, or other losses to the extent attributable to the renter’s actions, contractual obligations, and applicable law.

15.6. Responsibility for an accident or damage will be assessed in accordance with the circumstances, applicable law, and any relevant insurance coverage.

16. INSURANCE COVERAGE AND LIMITATIONS

16.1. Insurance coverage varies by motorcycle unit and is subject to the applicable insurance policy.

16.2. Compulsory Third Party Liability (CTPL) insurance does not automatically cover damage to the rented motorcycle, theft, the renter’s own injuries, or third-party property damage beyond the coverage expressly provided by the policy.

16.3. Comprehensive insurance, where available, is subject to the written policy terms, limits, exclusions, deductibles, and claim requirements.

16.4. The renter must immediately report incidents that may give rise to an insurance claim and cooperate with the insurer’s reasonable documentation requirements.

16.5. Insurance coverage does not automatically release the renter from contractual responsibilities or amounts properly payable under applicable law.

16.6. The renter may be responsible for uninsured losses or applicable deductibles to the extent provided by the rental agreement, insurance policy, and applicable law.

16.7. KJM Motorcycle Rental does not guarantee payment of an insurance claim where the claim is excluded, rejected, or limited under the insurer’s policy.

17. THEFT, LOSS OF KEYS, AND MISSING ACCESSORIES

17.1. The renter must take reasonable precautions to protect the motorcycle, keys, registration documents, helmets, and accessories from theft or loss.

17.2. The motorcycle must be parked in a reasonably secure location when not in use. The renter must not leave the keys in the ignition or leave the motorcycle unsecured.

17.3. Theft, attempted theft, lost keys, or missing accessories must be reported to KJM Motorcycle Rental immediately and to the police where appropriate.

17.4. The renter may be held responsible for documented losses, recovery expenses, or replacement costs to the extent permitted by the agreement and applicable law.

17.5. Any applicable insurance coverage and claim requirements will be considered when determining responsibility for the loss.

18. TRAFFIC VIOLATIONS, FINES, AND IMPOUNDMENT

18.1. The renter must comply with all applicable Philippine traffic laws and regulations.

18.2. The renter is responsible for traffic fines, parking penalties, and other charges arising from the renter’s use of the motorcycle during the rental period, to the extent legally attributable to the renter.

18.3. If the motorcycle is impounded, detained, or confiscated because of the renter’s actions or violations, the renter must notify KJM Motorcycle Rental immediately and cooperate in resolving the matter.

18.4. Reasonable, documented expenses arising from such incidents may be charged to the renter where permitted by law.

18.5. The renter must not use the motorcycle for any activity prohibited by applicable law.

19. MAINTENANCE, MECHANICAL PROBLEMS, AND REPAIRS

19.1. The renter must promptly report mechanical problems, warning lights, unusual noises, tire damage, or other concerns affecting the motorcycle’s safety or operation.

19.2. The renter must stop operating the motorcycle when it appears unsafe to ride and contact KJM Motorcycle Rental for instructions.

19.3. The renter must not modify, dismantle, or arrange non-emergency repairs to the motorcycle without prior authorization.

19.4. Damage resulting from misuse, negligence, unauthorized modifications, or failure to follow reasonable safety instructions may be charged to the renter where supported by the circumstances and applicable law.

19.5. Normal mechanical failures and ordinary wear and tear will be assessed separately from damage attributable to the renter.

19.6. The renter must not continue operating a motorcycle when doing so could cause further damage or create a safety risk.

20. PROHIBITED SUBSTANCES

20.1. Operating the motorcycle under the influence of alcohol, illegal drugs, or any substance that impairs the ability to ride safely is strictly prohibited.

20.2. The renter must not permit any person who is impaired, unfit, or legally disqualified from riding to operate the motorcycle.

20.3. Violations may result in termination of the rental agreement and other lawful remedies.

21. PROHIBITED USE

21.1. The rented motorcycle is intended for normal, lawful road use only.

21.2. The following activities are strictly prohibited:

  • Off-road riding or use on terrain for which the motorcycle is not intended or authorized.
  • Racing, speed competitions, stunts, reckless driving, or dangerous riding.
  • Use for any illegal activity.
  • Use for ride-hailing or passenger-for-hire services, including Angkas, Move It, Maxim, or habal-habal operations.
  • Use for delivery or courier services, including commercial delivery work.
  • Carrying loads or passengers beyond the motorcycle’s legal or manufacturer-specified limits.
  • Any activity that violates the rental agreement, applicable law, or insurance policy.

21.3. KJM Motorcycle Rental may terminate the rental agreement if the motorcycle is used in violation of these restrictions, subject to applicable law.

22. NO UNAUTHORIZED TRANSFER, SUBLEASING, OR MODIFICATION

22.1. The renter must not lend, sublease, sell, transfer possession of, or otherwise allow another person to use the motorcycle without prior written approval.

22.2. The renter must not alter the motorcycle’s mechanical components, bodywork, registration plates, identification markings, or installed security equipment without authorization.

22.3. Unauthorized modifications or transfers may constitute a breach of this agreement and may result in liability for documented losses attributable to the violation, where permitted by law.

23. LONG-TERM AND MONTHLY RENTALS

23.1. Long-term rental rates, payment schedules, included accessories, insurance arrangements, and rental periods must be specified in the applicable rental agreement.

23.2. Monthly or long-term rental privileges and rates do not automatically apply to a subsequent rental or extension.

23.3. Any extension must be approved in advance by KJM Motorcycle Rental. Extensions of less than one (1) month will be charged at the rate determined by KJM Motorcycle Rental and confirmed before the extension begins.

23.4. The renter must comply with the agreed payment schedule and make the motorcycle available for scheduled maintenance or safety inspections upon reasonable prior notice.

23.5. Early termination, outstanding rental payments, advance payments, and any applicable charges will be governed by the specific long-term rental agreement and applicable law.

23.6. If the long-term rental agreement specifies a minimum rental commitment or payment obligation upon early termination, that provision must be expressly agreed upon in writing and remains subject to applicable law.

23.7. Changes to the rental period, payment schedule, authorized use, or other material terms must be approved in writing by both parties.

24. CANCELLATION OR TERMINATION BY KJM MOTORCYCLE RENTAL

24.1. KJM Motorcycle Rental may terminate the rental agreement and request the return of the motorcycle if the renter materially breaches the agreement, fails to make required payments, provides false or misleading information, misuses the motorcycle, or creates a significant safety or security risk.

24.2. Where necessary and legally permitted, KJM Motorcycle Rental may arrange the lawful recovery of the motorcycle.

24.3. Termination does not automatically waive outstanding rental fees, documented damages, or other amounts properly payable under the agreement or applicable law.

24.4. Any recovery, collection, or enforcement action must be carried out lawfully and without violating the renter’s rights.

24.5. Refunds, if any, will be handled in accordance with the applicable booking terms, rental agreement, and law.

25. DELIVERY, PICKUP, AND RETURN ARRANGEMENTS
